Law Offices of Keith F. Carr (“we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose and safeguard your data when you visit our website located at www.keithfcarr.net (the “Site”) and use the various content and features (the “Services”). BY USING OR ACCESSING THE SITE OR THE SERVICES, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT USE OR ACCESS THE SITE.

COLLECTION AND USE OF INFORMATION

We may collect and use information about you in a variety of ways. Examples of the types of data we collect and use include:

Derivative Data.  Like most website operators, we gather from users of the Site information of the sort that web browsers, depending on their settings, may make available or that our servers automatically recognize when you access the Site or the Services. That information includes your Internet Protocol (IP) address, operating system and browser type, and the locations of the websites you view right before arriving at, while navigating and immediately after leaving the Site. Such information is not personally identifiable, but it still may be possible for us to determine from an IP address your Internet service provider and the geographic location of your point of connectivity, as well as other statistical usage data. We analyze such information to help us better understand how the Site is being used. By identifying patterns and trends in usage, we are able to better design the Site to improve your experiences, both in terms of content and ease of use. From time to time, we may also release this information in the aggregate, such as by publishing a report on trends in the usage of the Site.  

Personal and Financial Information.  At the time you register with the Site, we may collect “Personal Information” about you, which is information that, without more, can be directly associated with a specific person. Personal Information may include your name, residential or business address, email address and telephone number, and, if you transact business with us, financial information such as your payment method (valid credit card number, type, expiration date or other financial information). We also may request information about your interests, activities, gender, age, date of birth, username, hometown and other demographic or relevant information as determined by us from time to time. You are under no obligation to provide us with Personal Information of any kind, with the caveat that your refusal to do so may prevent you from using certain features of the Site or the Services. Your Personal Information is captured and stored with the submission of any form on this site. Your Personal Information is used for customer service purposes and not marketing purposes. When you submit data on any form on this site, you agree with the storage of your data. 

Email Communications.  We may occasionally use your name and email address to send you notifications regarding new services offered by the Site that we think you may find valuable. We may also send you service-related announcements from time to time. Generally, you may opt out of such emails at the time of registration or by following the unsubscribe link in the email communications, though we reserve the right to continue to send you notices about your account.

General Use.  We use the Personal Information we maintain about you, and other information we obtain from your current and past activities on the Site to: (1) deliver the products and services that you have requested; (2) manage your account and provide you with customer support; (3) communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you; (4) inform you of updates; (5) customize your experience; and (6) do as otherwise described to you at the time of collection. In particular, we may examine your Personal Information to identify users using multiple user IDs or aliases. We may compare and review your Personal Information for accuracy and to detect errors and omissions. We may use your financial information or payment method to process payment for any purchases made on the Site, enroll you in any discount, rebate, or other program in which you elect to participate, protect against or identify possible fraudulent transactions and do as otherwise needed to manage our business.

Media. If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Embedded content from other websites.  Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.  These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website.

Really Simple SSL and Really Simple SSL add-ons do not process any personal identifiable information, so the GDPR does not apply to these plugins or usage of these plugins on our website. You can find the privacy policy here.

Security Logs

The IP address of visitors, user ID of logged in users, and username of login attempts are conditionally logged to check for malicious activity and to protect the site from specific kinds of attacks. Examples of conditions when logging occurs include login attempts, log out requests, requests for suspicious URLs, changes to site content, and password updates. This information is retained for 2 days.

Who we share your data with

This site is scanned for potential malware and vulnerabilities by Sucuri’s SiteCheck. We do not send personal information to Sucuri; however, Sucuri could find personal information posted publicly (such as in comments) during their scan. For more details, please see Sucuri’s privacy policy.

How long we retain your data

Security logs are retained for 2 days.

Where we send your data

This site is part of a network of sites that protect against distributed brute force attacks. To enable this protection, the IP address of visitors attempting to log into the site is shared with a service provided by ithemes.com. For privacy policy details, please see the iThemes Privacy Policy.

DISCLOSURES OF INFORMATION

We may disclose your Personal Information under the following circumstances:

By Law or to Protect Rights. When we believe disclosure is appropriate, we may disclose your Personal Information: (1) in connection with efforts to investigate, prevent or take other action regarding illegal activity, suspected fraud or other wrongdoing; (2) to protect and defend our rights, property or safety or those of our users, our employees or others; (3) to comply with applicable law or cooperate with law enforcement; (4) in response to a subpoena or similar investigative demand, court order or request for cooperation from a law enforcement or other government agency; (5) to establish or exercise our legal rights; (6) to defend against legal claims; or (7) as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

Marketing Communications. Unless you opt-out from receiving our marketing materials upon registration, we may email you about products and services that we believe may be of interest to you, and we also may provide your email information to third parties so that those third parties may directly contact you about additional products and services. If you wish to opt-out of receiving marketing materials from us, you may do so by following the unsubscribe link in the email communications, by going to your account settings or by contacting us using the contact information provided below.

Third Party Service Providers.  We may share your Personal Information, which may include your name and contact information (including email address) with our authorized service providers that perform certain services for or on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, supporting the Site’s functionality and other features offered through the Site. We may also share your name, contact information and credit card information with our authorized service providers who process credit card payments. These service providers may have access to your Personal Information and/or financial information as needed to perform their functions, but are not permitted to share or use such information for any other purpose.

How long we retain your data.  If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data.  If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where we send your data. Visitor comments may be checked through an automated spam detection service.

TRACKING TECHNOLOGIES

Cookies. We use cookies on the Site to: (1) keep track of the Services you have used; (2) record registration information regarding your login name and password; (3) record your user preferences; (4) keep you logged into the Site; and (5) facilitate purchase procedures. We also use cookies to track the pages that you visit during each session, both to help us improve your experience and to help us understand how the Site is being used. We analyze and disclose in aggregated form information gathered using cookies, so as to help us, our partners and others better understand how the Site and the Services are being used. We do not attempt to link information gathered using cookies to your Personal Information. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site or the Services.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.  If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed. If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

Analytics. We may also partner with selected third party vendors, such as Google Analytics, to allow tracking technologies and remarketing services on the Site through the use of first party cookies (such as the Google Analytics cookie), including Google Analytics for Display Advertising and Google AdWords. If you do not want any information to be collected and used by Google Analytics, you can install a Google Analytics opt-out plugin  in your web browser, update your preferences in the Google Ads Settings page or use the Network Advertising Initiative opt-out tool. We are required to disclose our usage of Clicky: Privacy Policy.  

LINKS TO THIRD PARTY WEBSITES

The Site and the Services may contain links to third party websites and applications of interest, including advertisements and external services. However, once you have used these links to leave the Site, you should note that we neither own nor have any control over those third party websites or applications. Thus, this Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. Before visiting any third party websites or using any third party applications, whether by means of a link on the Site, directly through the Site or otherwise, and before providing any Personal Information to any such third party, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website or application, and should take those steps necessary to, in your discretion, protect the privacy of your data.

SECURITY

We use reasonable administrative, technical and physical measures to protect your Personal Information from loss, theft, alteration or misuse.  However, please be advised that even the best security measures cannot fully eliminate all risks. Any data disclosed online is vulnerable to interception and misuse by unauthorized third parties. We cannot guarantee that only authorized persons will view your Personal Information. We are not responsible for third party circumvention of any privacy settings or security measures.

CHANGING OR TERMINATING YOUR ACCOUNT

You may at any time review or change the information in your account or terminate your account by going to your account settings or by contacting us using the contact information provided below. Upon your request, we will deactivate or delete your account and Personal Information from our active databases. Such Personal Information will be deactivated or deleted as soon as practicable based on your account activity and in accordance with our deactivation policy and applicable law. We will retain in our files some of your Personal Information to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your Personal Information will be completely removed from our databases in response to your requests. Additionally, we keep a history of changed information to investigate suspected fraud with your account.

PRIVACY POLICY CHANGES

We reserve the right to make changes or modifications to this Privacy Policy at any time and for any reason. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification.

POLICY FOR CHILDREN

The Children’s Online Privacy Protection Act protects the online privacy of children under 13 years of age. The Site and the Services are not directed to children, and we do not knowingly collect or maintain Personal Information from anyone under the age of 13. If we learn that Personal Information has been collected from a user under 13 years of age, we will take the appropriate steps to cause this Personal Information to be deleted from our records. If you are the parent or legal guardian of a child under 13 years of age who has registered with the Site or has otherwise transferred Personal Information to the Site, please contact us using the contact information provided below to have your child’s account terminated and Personal Information deleted. If you are under 18 years of age, reside in California and have a registered account on the Site, you have the right to request removal of unwanted Personal Information that you publicly disclose on the Site. To request removal of such Personal Information, contact us using the contact information provided below and include a statement that you reside in California. While we will make sure the Personal Information is not publicly displayed on the Site, please be aware that the data may not be completely or comprehensively removed from our systems.

CALIFORNIA PRIVACY RIGHTS

Note that our law office does not disclose information about the Personal Information to third parties for direct marketing purposes. 

DO-NOT-TRACK FEATURE

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. Because there is not yet a common understanding of how to interpret the DNT signal, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.
